Booking Terms & Conditions – Effective from October 20th 2014

1. General

The following terms and conditions apply to your rental of Lemon Tree Cottage. The rental agreement is a contract directly between the Property Owner and the Tenant. It is important that you know what obligations you have and what we will provide you with in return.
A binding contract between the person who completes and signs the Booking Form and the Property Owner will be made when we issue a confirmation by e-mail or letter.
You are responsible for payment of the price of the rental and the compliance of members of your party with these conditions.
We cannot accept bookings from persons under 21 years of age at the time of booking. We reserve the right to refuse a booking without giving any reason.

2. Price

The price is per week for the property, in £ sterling, as published on our website. Fewer or greater number of nights are charged pro-rata. The minimum stay during peak seasons is 7 nights.
Whilst we reserve the right to change prices at any time, the cost of the rental is guaranteed as soon as you have completed and signed the Booking Form and paid your booking deposit or full payment. 
The price guarantee is applicable provided that you make no changes to your holiday arrangements and that you adhere to our terms and conditions.
Lemon Tree Cottage is let fully furnished and equipped and the price includes water, gas and electricity. It does not include holiday insurance, car hire, flights or airport transfers.

3. Pre Booking

We will agree and hold a provisional booking with you for 48 hours, during which you can arrange flights etc.
Please do not make your travel arrangements before you have agreed a provisional booking with us.

4. Confirming the Booking

We require payment of a non-refundable deposit of 30% of the rental price and, the completed and signed Booking Form within 7 days to secure your booking. Should either not be received within 7 days, we reserve the right to cancel your provisional booking and offer the accommodation to other interested parties
You can make payment to us directly into our UK bank account, personally over the counter at a bank branch or via Internet banking transfer. We will provide details when we make the provisional booking.
Upon receipt of your 30% booking deposit and, providing that we also have your completed and signed Booking Form, we will send you a receipt and secure booking confirmation.

5. Payment in Full

The balance of the payment due and the damages deposit must be received no later than 8 weeks before the date rental starts. We reserve the right to consider your failure to pay the balance and the damages deposit on time as cancellation and cancellation charges are payable in accordance with paragraph 8. (Cancellation by you - below).
If the booking date is less than 8 weeks before the intended rental start date, the rental price and damages deposit must be paid in full at the time of booking.
Once we have received your full payment together with your Returnable Damages Deposit, we will send you a receipt and detailed directions from Faro Airport.

6. Returnable Damages Deposit

We require payment of a £300 Returnable Damages Deposit to cover any breakages and/or damage/loss caused to property during your stay. The Returnable Damages Deposit includes £50 security deposit for the remote control for the electric gates.
The Returnable Damages Deposit must be paid 8 weeks before the date rental starts.
Provided that nothing is reported damaged, lost or broken, the Returnable Damages Deposit will be returned to your home address shortly after your departure.
We ask that you report all damage as soon as possible. We understand normal wear and tear and the following provisions do not apply to normal wear and tear or minor breakages.
We reserve the right to replace or repair any breakage/loss at your expense and to deduct the costs from the Returnable Damages Deposit accordingly. Breakage, loss or damage may postpone the Returnable Damages Deposit refund until after the repairs/replacement have been completed. If the Returnable Damages Deposit is insufficient to cover repair/replacement costs, you must pay the additional costs before you depart. 
Payment will be required on major breakages, damage, loss, tearing and soiling of linen and other items within the property. This includes costs to clear any blockage to the cottage saniflow toilet/drainage system, lost keys, changing of locks and forceful entry (if required).

7. Cancellation or Alterations by Property Owner

In the unlikely event that circumstances beyond our control necessitate a cancellation of the rental agreement, we reserve the right to cancel any booking at any time and would only be liable to refund monies already paid by you to us. This will be the full extent of our liability in such circumstances, and we will not be responsible for any other costs connected with any such cancellation, howsoever arising.

8. Cancellation by you

Any cancellation by you (for whatever reason) must be advised to us as soon as possible  in writing by e-mail and post.
The effective cancellation date is the date on which we receive written cancellation by either e-mail or post.
If you cancel 8 weeks or more before the rental start date we reserve the right to retain all payments already made (except the returnable damages deposit). In the event that the accommodation can be re-let, the deposit may be refunded in full without prejudice.
If you cancel within 8 weeks of the rental start date or if the booking is cancelled by us because of non-payment, we shall be entitled to recover, if not already paid, the balance of the hiring charge as follows:

30 - 56 days notice: 50% of the rental cost
Less than 30 days notice: 100% of the rental cost

9. Amendments by you

Upon receipt of your booking confirmation e-mail, letter or invoice, please check that the details are correct. If, after your booking has been accepted, you require us to amend it in any way or to re-invoice you, we reserve the right to charge a £50 amendment fee. We reserve the right to treat a change of rental dates as a cancellation of one rental and the booking of another.

10. Occupancy

Only those persons named on the Booking Form may use the property. Lemon Tree Cottage accommodates four adults. If you arrive with more than four adults in your party, we reserve the right to cancel your booking and your payments will automatically be forfeited unless you have made special arrangements with us.

11. Arrival and Departure

The rental commences, and you may enter the property, at 12:00 hours on the rental start date. If you arrive after 8 pm  you may not be able to occupy the property until the next day.
The rental ends at 12:00 hours and the property must be vacated at Noon latest on the last day of the rental period.
These timings allow you the maximum use of the property as we allow a full day between rentals to ensure that the property is maintained to a high standard for all guests.

12. Access

The Property Owner, or any nominated representative of the Property Owner shall be allowed free access to the property at any reasonable time during the rental period for the purpose of inspection, repair and maintenance duties.

13. Your Responsibilities

You must keep the property and all furniture, fittings, effects, facilities and equipment, including sports equipment, in the same state of repair and condition as at the commencement of the rental. You are responsible for any degradation on the property and its contents by your own fault or by one of your guests.

The property will be clean throughout at the commencement of the rental period. You must leave the property in the same state of cleanliness and general order in which it was found.

Crockery and all kitchen utensils etc must be washed, dried and stored away. Unwanted/opened food items and rubbish must be disposed of in the public rubbish bin at the cross roads – within 100m or the property. Should we have to dispose of your rubbish or clean up after you we will make a charge of £40 per hour against your damages deposit.

14. Wilful or Malicious Damage

If it is determined that you are causing wilful or malicious damage to the property or contents, you will be asked to immediately leave the property. No refund will be made and the cost of repairs of such damage will be fully chargeable before leaving Portugal. Our policy is to bring such actions to the notice of the Guarda National Republicana in Portugal.

15. Pet Policy

We have  a strict NO PETS policy and pets are not accepted under any circumstances.

16. Children

For safety reasons, children are not generally accepted. However, we may accept children aged 12+ by prior arrangement under some circumstances at our sole discretion.

17. Smoking Policy

We have a strict NO SMOKING policy inside Lemon Tree Cottage. However, you may smoke on the outside terraces if you wish to do so. Cigarette ends are not bio-degradable and we ask that you do not use the garden as an ash tray. You must extinguish and dispose of your cigarettes responsibly. We do not wish to see cigarette ends littering the property.
In addition, there is a significant danger of fire during the long dry summer in the Algarve and you must take great care to avoid causing a fire as much of the garden can be tinder-box dry.
Smoking indoors will be considered a breach of the booking conditions and will result in the you being asked to vacate the property.  In such an event, you will forfeit the rental period, the Returnable Damages Deposit and all costs that you have paid.  You will be liable for a deep clean fee which will include, but is not limited to, professional cleaning of all soft furnishings, linens, rugs etc as well as a “clean air” fee, to de-odorise the accommodation.

18. Travel Arrangements

We accept no liability for making your travel arrangements to Lemon Tree Cottage. You are responsible for your passports, visas (if required) travel insurance, car hire  and for making the correct arrangements for travel.

19. Privacy Policy

We are committed to protecting your privacy. We ask you only for a minimal amount of information to enable us to make your booking. We will not pass any details to a Third Party.

20. Insurance

It is a condition of booking the property that your party is covered by comprehensive travel insurance. The cover provided by this policy must include illness, cancellation, personal and 3rd party injury, loss and personal liability etc. Medical insurance is strongly advised.
Your signature on the Booking Form confirms that you have agreed to be, and are, covered by such insurance.

21. Information

While we make every effort to ensure that the descriptions of the property and its facilities are accurately reproduced we cannot accept responsibility for errors contained therein or the results of thereof.  You must accept that minor differences between the photography/text used and the actual property may arise.

We reserve the right to make modifications of the property specification that are considered necessary in the light of operating requirements.  In the interests of continued improvement, we reserve the right to alter furniture, fittings, amenities, facilities or any activities, either advertised or previously available, without prior notice.

If material changes occur after your booking has been confirmed we will advise you, if there is time, before your rental begins.

22. Complaints

We sincerely hope you don’t have any reason to complain and we try to do everything that we possibly can to make your stay enjoyable.
However, if you wish to register a complaint during your holiday, please let us know immediately and we will try to rectify the matter as expeditiously as we can.
If you prefer to make a written complaint please do so whilst there is still time to do something about the complaint.
Whilst we carry out major maintenance work when there is nobody staying at the property, any urgent maintenance work or repairs will be carried out as and when necessary. We will make every attempt to avoid or minimise any inconvenience to you wherever possible

23. Security and Valuables

Any valuables left at the property are left entirely at your own risk.  We are not responsible for their loss.  Although there is little history of burglary and theft in the locality and none at Vivenda Madeira, there may be a risk of burglary.

Proper care must be taken against theft and burglary and we have a wall safe for your valuables in the front bedroom. We accept no liability for any valuables kept in the safe. The facility is provided without any guarantees.

When leaving the property empty, the patio doors and windows should be closed and locked. The front door must be locked. We ask that you keep both sets of gates (i.e. top and bottom gates) closed whilst in the property and when leaving it.

If there is a burglary and all proper and safe care has not been practised and the Property Owner’s property is stolen, the Tenant will be held entirely responsible.

Any burglary must be reported to the local police within 24 hours of occurrence and a crime reference number/report must be obtained for your insurance purposes and for the owner’s insurance purposes.

We accept no responsibility for any loss, damage or consequential losses due to theft or any other security related incident howsoever caused.

If you lose any keys to the property you should notify the Property Owner immediately. A charge of £30 to replace lost keys and £50 for an electronic remote control will be made. If there is a need for any forced entry the costs incurred will be charged to the tenant.

24. Liability of the Property Owner

We shall not be responsible for the death of or personal injury to you or any person named on the Booking Form or any other person at the property, in the swimming pool and in the grounds of the property. You and your party are responsible for taking all necessary safety precautions when using the property, gardens and grounds, and the swimming pool.

We shall not be liable for any loss, breach or delay due to any cause, including though not limited to Act of God, explosion, flood, tempest, fire or accident, war or threat of war, civil disturbance, acts, restrictions, regulations, bye-laws or measures of any kind on the part of any governmental or local authority, strikes, lock-outs, or other industrial actions or disputes or adverse weather conditions.  In any such case we shall be entitled to treat the contract as discharged.

In the event of such discharge our liability shall be limited to the return of the sums paid to us in respect of the (unused) portion of the rental calculated on a pro rata daily basis.

We shall not be liable for any loss, damage or expense, injury or inconvenience suffered by guests by reason of any defects in the structure of the property, swimming pool or grounds, plumbing, electrical systems, gas or water systems or any cause whatsoever in connection with the property or failure in the supply of utilities, although every care is taken.

We accept no responsibility for you or your guests property while you or they are in the property, gardens or pool area. We accept no responsibility for lost, misplaced or stolen property, which you or your guests may have left in the accommodation or grounds.

We accept no responsibility for the sudden failure of accommodation equipment but will take reasonable action to rectify such failure upon notification by you.

We accept no liability for loss of main services or failure of appliances, nor for the consequences of the actions or omissions of person(s) who may control supply of mains service, nor any actions taken in the vicinity of the property by any authority over which there is no control by us. Furthermore, it is possible that some construction work may take place in local area to which we are not responsible for.
We have Freesat satellite TV in the property. During heavy rainfall, high winds and low lying cloud there may be a loss of the satellite TV signal and we accept no responsibility for such occurrences.

25. Behaviour

The person signing the Booking Form is responsible for the correct and decent behaviour of his/her party.  Should you and your party not behave in such a manner, we may at our absolute discretion ask you and your party to vacate the property without a refund of the rental fee.

You are reminded that the civil and criminal laws of Portugal apply to the Tenant and all guests in the rental party whilst in Portugal and this includes drug use laws which are severe.

26. Swimming Pool

Vivenda Madeira and Lemon Tree Cottage are enclosed within a fully fenced and gated garden WITH NO ADDITIONAL PROTECTIVE FENCING AROUND THE IMMEDIATE POOL AREA. Children must be supervised in or around the pool and gardens at all times.

We accept absolutely no liability for death or injury howsoever caused as a result of using the pool or the surrounding area. The Tenant remains responsible for the safety of those using the pool at all times. By placing the booking you are accepting full responsibility.  You and your guests may use the swimming pool at your own risk. You should always observe the safety rules listed in the information book provided in the property.Great care must be taken at all times when around and using a swimming pool. You should never use the pool under the influence of alcohol or drugs.  Always familiarise all members of your party with the shallow and deep end of the pool. Diving is not permitted.  No ball games are allowed in the pool area. Glass, crockery, beer bottles, wine bottles etc around the pool are a potential hazard and we ask you to take great care. In the event that broken glass enters the pool, the pool may have to be drained for cleaning and you will be charged for the entire expense of pool draining and re-filling the pool, which takes at least 3 days (during which time you will not be able to use the pool)and a cost of ca. €1000 for the salt and other chemicals.

27. Pool Operation and Safety

The pool is cleaned and the water analysis is checked  regularly for your safety and comfort. In the unlikely event that we need to correct unbalanced water chemistry we will tell you. On the rare occasion that we ask you to refrain from bathing because of water maintenance you must observe the instruction for your own safety.

State-of-the-art equipment is used to maintain safe and hygienic water quality. In particular, we employ the Eco-matic™ Salt Water Pool Sanitising System which is claimed to be the most advanced pool sanitising system in the world. This enables us to sanitise the pool water without using the powerful chlorine chemicals normally used to kill bacteria.

We use automatic pH correction equipment to maintain a neutral and healthy pH of 7 ~ 7.2 at all times.

The system that we employ requires the circulation pumps to operate periodically throughout a 24-hour period to circulate the pool water through the filter and to remove chloramines – compounds formed when nitrogen from perspiration and other body fluids are present.
Chloramines cause eye and skin irritation as well as unpleasant odours. Please take a shower before bathing and refrain from urinating in the pool to minimise production of chloramines - access to an outside WC is provided for this purpose! Do not interfere with the skimmers, the vacuum point or jets returning re-circulating water back into the pool.

You are not permitted to enter the pump room in which the swimming pool equipment is located nor are you permitted to ever touch any equipment or controls associated with it.

28. Main House and grounds

You and your guests are not permitted to enter the main house - Vivenda Maderia, or its garage, pool room, pump room, boiler room, gas bottle room or tool shed. Access to the outside WC with a handbasin is provided.

Please be careful of insects (wasps and centipedes in particular), steps, sharp plants and rocks in the garden and pool area. A small first aid kit is provided in the cottage normlly found under the kitchen sink. An accident and emergency service is available in Loule.

You are not permitted to interfere with any of the outside automated irrigation system components (taps, hoses, pipes or irrigation nozzels). This could upset the timed irrigation system and lead to the perishing of plants and trees, for which you will be liable, and the cost of which will be deducted from your damages deposit.
